1. General
- The promoter of this Lottery is The Galway GAA.
- The laws of the Republic of Ireland govern these Terms and Conditions.
- The Lottery Licence for this Competition was granted in the District Court Area of Galway Licence D:LIC:GALW:2025:005583 from October 2025 to March 2026.
- The purpose of the Lottery is to raise funds to complete infrastructure work by the Galway County Board for Galway GAA activities. The Lottery organisers shall not derive any personal profit from the Lottery, and the intended beneficiary is the promoter as stated in point 1.
- The Lottery is open to all natural persons aged 18 years or older. Any tickets purchased by persons under the age of 18 years shall be declared null and void and shall not be included or deemed to be included in the Lottery, and another ticket will be drawn in its place. If any persons named on a ticket are under the age of 18 years at the time of purchase, then it will be deemed that the purchaser is the ticket holder. At all times, the purchaser must be 18 years or older at the date of ticket purchase.
2. Ticket Purchase
- The cost of a lottery ticket is €100.00.
- By purchasing a lottery ticket, the ticket holder agrees to be bound by these Terms and Conditions.
- Members of the Lottery Committee, Galway County Board executive, Galway County Board GAA committee members, the developer of Bothar Na Mais and their spouses/partners are expressly precluded from winning any prize related to this lottery.
- Tickets are available to purchase as a hard ticket or online at www.winahomeongalwaybay.com.
- Tickets may be purchased by all natural persons aged 18 years or older as a gift for a nominated person over 18 years old. In this case, the nominee will be the ticket holder and prize recipient.
- The maximum number of Lottery tickets available is 20,000. There is no limit to the number of tickets an individual may purchase.
- Tickets are non-refundable, except if the lottery draw is cancelled. In this case, a maximum of €90.00 per ticket will be refunded, with the remaining €10 retained to cover administrative costs. Refunds will be processed within 30 days of cancellation.
3. Liability
- The promoter and its representatives are not liable for any failure to perform obligations due to factors beyond their control. The promoter is not liable for delays, errors, or failures related to ticket purchases, including online payment processing issues, technical malfunctions, or force majeure events.
- The promoter and its representatives accept no liability for any loss, damage, inconvenience, or expense suffered by ticket holders participating in the Lottery. The promoter has no liability for indirect or consequential losses suffered by ticket holders.
- Lost or stolen physical tickets will not be replaced. Digital ticket holders may request a reissue by contacting the promoter, subject to verification.
4. The Prize
- The Prize is a 2-bedroom end terrace home at No. 71 Bothar Na Mias, Kinvara, Co. Galway (“the Property”), with a value of €360,000 as of 14th November 2025.
- The prize is as stated, and no cash or other alternatives will be offered. The prize is non-transferable and vests in the winner only.
- The Property is in a managed development, and management fees of €500 per year will apply.
- The promoter reserves the right to add additional prizes, which will be notified via winahomeongalwaybay.com the related Facebook profile and media outlets.
5. The Draw
- The Lottery Draw will be held on 22nd March 2026 at 9pm in The Galmont Hotel, Lough Atalia Road, Galway, H91CYN3 .
- The draw will be broadcast live on Facebook Live and independently overseen by an independent auditor or legal professional. The Promoter will maintain books and records recording all entries into the Lottery and all costs relating to the Lottery. The Promoter’s decision in respect of the winners and all or any other matters concerned with this Lottery is final.
- The promoter reserves the right to change the draw date or venue and will notify ticket holders via winahomeongalwaybay.com, related Facebook profile, media outlets and by email.
6. Winner Selection & Prize Claim
- The winner will be announced within 28 days of the draw via winahomeongalwaybay.com, local and national press, email, Facebook, and other social media profiles.
- The winner must contact the promoter via email, post, social media, or in person at the promoter’s registered location.
- The winner will be subject to verification, which may take up to 7 days. The winner must provide proof of identity, age, and address within a specified period.
- If the winner cannot be contacted or does not claim the prize within 30 days, the promoter reserves the right to select a replacement winner.
- If the winner does not appoint a solicitor within 60 days of claiming the prize and complete the transfer within six months, the promoter reserves the right to select a replacement winner.
- The promoter may disqualify a winner if any information provided is false, misleading, or incomplete.
7. Prize Transfer & Costs
- The legal title to the Property will be transferred to the winner free from any financial interest, entitlement or encumbrances in favour of the Promoter as soon as practicable following the Lottery Draw.
- The winner must appoint their own solicitor to complete the transfer. Failure to appoint a solicitor within the stated period allows the promoter to reallocate the prize to an alternative winner.
- The winner is responsible for all costs associated with the transfer, including:
- Solicitor’s fees
- Stamp duty
- Registration expenses
- Any other related costs
- The winner must apply for membership of the Management Company, adhere to the rules, execute required documentation, and pay annual management fees.
8. Property Condition
- The promoter does not warrant the condition of the Property and is not liable for any issues related to its state, repair, or construction. The promoter nor any of its servants, agents, licensees, trustees, committee members or the organisers of the lottery shall not be in any circumstances liable for any loss, damage, inconvenience or expense suffered by the winner in relation to the state, condition, repair or construction of the Property.
- The winner must accept the property ‘as is’, as provided, including its fit-out and finish, with no guarantees about defects, compliance with planning laws, or condition of fixtures and with no recourse to the promoter.
9. Taxes
- The winner is solely responsible for any tax liabilities, including Capital Gains Tax. The promoter encourages winners to seek independent tax advice.
10. Amendments & Cancellations
- The promoter reserves the right at all times to amend the lottery and the terms and conditions herein set out, and in purchasing a lottery ticket, each lottery ticket holder consents and agrees to be bound by the said amendments. The promoter further reserves the right to cancel this Lottery for any reason whatsoever. The cancellation or any change to the lottery or these terms and conditions will be notified to the lottery ticket holders as soon as practicable in respect thereof.
11. Dispute Resolution
- Any dispute arising out of this Lottery shall be resolved under Irish law. If unresolved, it will be referred to arbitration in Ireland.
12. Data Protection & Publicity (General Data Protection Regulations (GDPR))
- By purchasing a lottery ticket, the holder agrees to the promoter retaining and using personal data for the duration of the lottery and for three years thereafter, solely in connection with the lottery and other Lotteries run by the promoter. Lottery ticket holders can opt out of future marketing on request.
- Personal data will not be shared with third parties without consent, except where required for the prize transfer. The winner of the Property agrees and consents to his or her personal data being released to relevant third parties to effect the transfer of the Property to him/her.
- Prize winner(s) agree to participate in reasonable publicity, including media releases, key hand over and any other photographs and use of winner’s name(s) and area/county of residence.
13. Force Majeure
- The promoter is not responsible for unforeseen events (e.g., natural disasters, pandemics, regulatory changes) that may affect the lottery.
14. Miscellaneous
- The Promoter, its servants, agents, licensees, trustees, committee members or the organiser of the Lottery accepts no responsibility whatsoever, whether due to error, omission, alteration, tampering, deletion, theft, destruction, transmission, interception or communication failure, for unreceived, late, missing, incomplete, incorrectly submitted, corrupted or misdirected claims, entries, applications or otherwise.
